Disclaimer

Important limits on the information on debaryvfa.org, including that we are not an emergency service and that gifts to our 501(c)(4) are not tax-deductible.

In short: We are a volunteer support organization, not a fire department or emergency service. In an emergency, call 911. Our safety information is general and educational. We support, but do not speak for, the City of DeBary, the Orange City Fire Department or Volusia County. Gifts to our 501(c)(4) organization are not tax-deductible as charitable contributions. We work to keep information accurate but cannot guarantee it is complete or current.

This Disclaimer applies to debaryvfa.org (the “Site”), operated by The DeBary Volunteer Firemen’s Association, Inc., doing business as The DeBary Volunteer Fire Support Team (“the Association,” “we,” “us” or “our”). It explains important limits on the information we publish and on what the Association is and does. It is part of our Terms and Conditions.

1. We are not an emergency service

Emergency? Call 911 right away. Do not use our website, forms, email, phone line or Facebook page to report a fire, medical emergency, crime or other urgent situation.

The Association is a volunteer organization founded in 1953 that supports the firefighters who serve DeBary, Florida. Today, our volunteers provide support such as firefighter rehab (water, sports drinks, snacks, ice, shade and cooling) at emergency scenes, community fire-safety education and fundraising for equipment and supplies. You can read more about this work on our What Does a Support Unit Do? and Services pages.

We are not a fire department. We do not respond to calls for help, fight fires, perform rescues or provide emergency medical care. Fire and rescue service in DeBary is provided by the Orange City Fire Department under a contract with the City of DeBary. Our forms, email inbox and phone line (386-801-2469) are monitored by volunteers when they are available, not around the clock. Messages may go unread for hours or days.

For non-emergency questions about fire inspections, burn permits, fire codes, smoke alarm programs or fire department services, please contact the City of DeBary or the Orange City Fire Department directly.

2. Safety information is educational, not professional advice

The Site includes fire-safety, hurricane, generator, brush fire, smoke alarm, cooking, battery charging and other preparedness information, such as our Safety page and Fire Safety Checklist. This information:

  • is general and educational, and is intended to raise awareness and encourage safe habits;
  • is based on publicly available guidance from sources such as the National Fire Protection Association (NFPA), the U.S. Fire Administration, the U.S. Consumer Product Safety Commission and other agencies we cite, which may change over time;
  • is not a substitute for professional advice from a licensed electrician, fire protection professional, building official, physician, engineer or other qualified expert;
  • is not a fire inspection, code interpretation or assessment of any particular home, building, product or plan; and
  • may not reflect the specific rules that apply where you live, including local ordinances, burn bans, evacuation orders and building codes.

Always follow the instructions of emergency officials, including the Volusia County Division of Emergency Management, the National Weather Service and local fire officials, and follow the manufacturer’s instructions for smoke alarms, carbon monoxide alarms, generators, batteries, chargers, appliances and other equipment. If guidance on our Site conflicts with instructions from officials or manufacturers, follow the official or manufacturer instructions. You are responsible for decisions you make about your own safety and the safety of your household and property.

Our fire-safety presentations are offered on the same educational basis. They are not inspections or professional consultations.

3. Our relationship with government and fire service agencies

The Association is an independent Florida not-for-profit corporation. We proudly support the firefighters who serve our community, and we work cooperatively with local agencies. However:

  • We are not part of, an agency of, or a contractor of the City of DeBary, the Orange City Fire Department, the City of Orange City, Volusia County or Volusia County Fire Rescue, or any state or federal agency.
  • We do not speak for any of those organizations. Statements on the Site, on our Facebook page or by our members reflect the views of the Association, not the official position of any government or fire department.
  • Mention of a government agency, fire station, firefighter, official or program on the Site, including information about Fire Station 33 and Fire Station 39, does not mean that agency endorses the Association, our fundraisers or our products.
  • Equipment, supplies and funds we raise for firefighters are provided as support, subject to the receiving agency’s policies and acceptance.

For official information about city services, fire department operations, emergency management or public safety announcements, please consult the official websites and channels of the City of DeBary, the Orange City Fire Department and Volusia County.

4. External links and no endorsement

The Site links to external websites, including government agencies, safety organizations, news articles, our Facebook page, and payment services such as PayPal and Venmo. We provide these links for convenience and further reading. We do not control those websites, and a link does not mean we endorse, sponsor or are affiliated with the linked organization, its views, products or services. We are not responsible for the accuracy, availability, security or privacy practices of external websites. Please review each website’s own terms and privacy policy.

Similarly, references on the Site to any specific product, brand, business or service (for example, a type of smoke alarm or generator) are for general information and do not constitute an endorsement or recommendation by the Association.

5. Tax disclaimer

Contributions or gifts to The DeBary Volunteer Firemen’s Association, Inc. are not deductible as charitable contributions for federal income tax purposes.

The Association is recognized by the Internal Revenue Service as a tax-exempt social welfare organization under section 501(c)(4) of the Internal Revenue Code. It is not a 501(c)(3) charitable organization. As required by section 6113 of the Internal Revenue Code, we disclose that donations to the Association, including donations made through our shop, by check, through PayPal or Venmo, at events or through our mailer campaign, are not deductible as charitable contributions on your federal income tax return. Purchases of items such as our challenge coin are purchases, not donations.

In some cases, a payment to a 501(c)(4) organization may be deductible as an ordinary and necessary business expense. Whether that applies to you depends on your circumstances. Nothing on the Site is tax, legal or accounting advice. Please consult a qualified tax professional about your situation.

6. Accuracy and currency of information

Our volunteers work hard to keep the Site accurate and up to date. However:

  • Information may contain errors or omissions, or may become out of date. We do not guarantee that any information on the Site is complete, accurate or current.
  • Our History pages draw on the Association’s own records, archives, photographs and members’ recollections from more than seven decades. Dates, names and details from older records may be incomplete, and we welcome corrections.
  • Articles, statistics and safety guidance reflect information available when they were written or last reviewed. Sources may update their figures or recommendations after that date.
  • We may change, update or remove content at any time without notice.

If you spot an error, please let us know through our contact page so we can review and correct it.

7. Photographs, images and fair use

Photographs and graphics on the Site come from several sources: photos taken by our members, historical photographs from the Association’s archives, and openly licensed or public-domain images from other sources. Images provided by others are credited, with their licenses, on our Image Credits page. Some images are illustrative and may not show the specific people, vehicles, stations or events described in the surrounding text.

Where we use limited excerpts of copyrighted material, such as brief quotations from news coverage, for commentary, education, history or reporting on the Association’s activities, we believe such use is a fair use under section 107 of the U.S. Copyright Act. If you are a copyright owner and believe material on the Site is used without permission, please see our DMCA Policy. If you appear in a photo on the Site and would like it removed, please contact us and we will review your request promptly.

8. Events and schedule changes

Event information on the Site, including our Upcoming Events page and Calendar, is provided in good faith but is subject to change. Pancake breakfasts, meetings, drill nights, presentations and other events may be rescheduled, relocated or cancelled because of weather, emergencies, facility availability, volunteer availability or other reasons, sometimes on short notice. Because our members may be called to support firefighters at an active incident, planned activities can change unexpectedly. Please check the Site or our Facebook page, or contact us, before traveling to an event.

9. Fundraising and solicitation notice

The Association does not fundraise door to door. Our fundraising takes place through events, our online shop, our annual mailer campaign and the official payment links on this Site. If someone contacts you asking for money in the Association’s name in a way that seems unusual, please contact us to confirm before giving.

10. No warranties; limitation of liability

The Site and all information on it are provided “as is” and “as available,” without warranties of any kind, express or implied. To the fullest extent permitted by law, the Association and its officers, directors, members, volunteers and agents are not liable for any loss, injury or damage arising from your use of, or reliance on, the Site or any information on it, or from any website linked from it. This Disclaimer should be read together with the disclaimer, limitation of liability and governing law sections of our Terms and Conditions, which apply to this page as well. Florida law governs this Disclaimer, and venue for any dispute lies in Volusia County, Florida, as described in those Terms.

11. Changes to this Disclaimer

We may update this Disclaimer from time to time. When we do, we will revise the “Last updated” date at the top of this page. Please check this page periodically.
