Terms and Conditions

The terms that apply when you use debaryvfa.org, order from our shop, donate, attend our events or request use of the Association Hall.

In short: Please use our website lawfully and respectfully. Our name, logos and content belong to the Association or are used with permission. Shop orders are paid by check by mail or at local pickup, ship within the U.S. only, and are covered by our Donation, Shipping & Refund Policy. Donations are not tax-deductible as charitable contributions. If you attend an event or use our hall, you accept certain risks and responsibilities. Florida law applies. We are not an emergency service: call 911.

These Terms and Conditions (“Terms”) govern your use of debaryvfa.org (the “Site”) and the services offered through it by The DeBary Volunteer Firemen’s Association, Inc., doing business as The DeBary Volunteer Fire Support Team (“the Association,” “we,” “us” or “our”). Please read them carefully.

1. Agreement to these Terms

By accessing or using the Site, submitting a form, placing an order, making a donation, attending an Association event, or using the Association Hall, you agree to these Terms and to our Privacy Policy, Cookie Policy, Disclaimer and Donation, Shipping & Refund Policy, which are part of these Terms. If you do not agree, please do not use the Site or our services.

If you use the Site or our services on behalf of an organization (for example, a school, club or homeowners’ association requesting a presentation or hall use), you represent that you have authority to accept these Terms on its behalf, and “you” includes that organization.

2. About the Association and emergencies

The Association is a Florida not-for-profit corporation founded in 1953 and a tax-exempt social welfare organization under section 501(c)(4) of the Internal Revenue Code. Our volunteers support the firefighters who serve DeBary, for example by providing firefighter rehab at emergency scenes. We are not a fire department and do not provide fire, rescue, medical or other emergency services. Fire service in DeBary is provided by the Orange City Fire Department under contract with the City of DeBary. Nothing on the Site or in any message from us is a substitute for emergency help. In an emergency, call 911. Do not use our forms, email, phone line or social media to report an emergency.

3. Eligibility

  • You must be at least 13 years old to use the Site. Children under 13 may view the Site only with the involvement of a parent or guardian and should not submit personal information.
  • You must be at least 18 years old (or the age of majority where you live) to place an order, make a donation, submit a hall-use request or enter into any agreement with us. Users between 13 and 18 may submit the contact or volunteer interest form with the knowledge of a parent or guardian.
  • You may not use the Site if you are barred from doing so under applicable law.

4. Use of the Site

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable permission to view and use the Site for your personal, non-commercial use and for the purposes of supporting, learning about and engaging with the Association. You may print or share links to individual pages for non-commercial purposes, including our fire-safety information, as long as you do not change the content and you keep any copyright and credit notices.

We may change, suspend or discontinue any part of the Site at any time, without notice. We may restrict or end your access to the Site if we reasonably believe you have violated these Terms or the law.

5. Intellectual property

The Site and its content, including text, graphics, page design, the Association’s name, our logos, emblems and patches, the design of our 70th Anniversary Challenge Coin, and photographs, are owned by the Association or are used under licenses or permissions from their owners. Photos and graphics provided by others are credited on our Image Credits page, along with the license that applies to each.

  • You may not copy, reproduce, modify, distribute, sell or create derivative works from Site content except as allowed by Section 4, by the license credited for a particular image, by fair use or other law, or with our prior written permission.
  • You may not use the Association’s name, logos or emblems in a way that suggests we sponsor, endorse or are affiliated with you, your product or your cause, or to solicit money, without our prior written permission.
  • Names and logos of other organizations, such as the City of DeBary, the Orange City Fire Department or Volusia County, belong to their owners. Their appearance on the Site does not mean those organizations endorse the Association or the Site.

If you believe content on the Site infringes your copyright, please follow the procedure in our DMCA Policy.

6. User submissions

When you submit information through our contact, hall-use request, fire-safety presentation request or volunteer interest forms, or otherwise send us messages, ideas, photos or other material (“Submissions”):

  • You confirm that the information you provide is accurate and that you have the right to provide it, including any information about other people.
  • You agree not to submit anything unlawful, threatening, harassing, defamatory, obscene, infringing, misleading, or containing malware, and not to submit sensitive information such as Social Security numbers, financial account numbers or medical information.
  • You understand that Submissions are not confidential, except that we will handle personal information as described in our Privacy Policy.
  • If you send us suggestions, feedback, stories or photos and tell us we may share them, you grant the Association a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, edit, display and share them in connection with our mission (for example, on the Site or our Facebook page), with credit where reasonable. You keep ownership of your material.
  • Submitting a form does not create a membership, an agreement for hall use, or a commitment by us to provide any service. We will reply as our volunteers are able.

7. Prohibited conduct

When using the Site, you agree not to:

  • violate any law or regulation, or anyone else’s rights, including privacy and intellectual property rights;
  • impersonate the Association, any of our members, any firefighter or public official, or any other person, or misrepresent your affiliation with anyone;
  • use the Association’s name to solicit donations or sell goods without our written authorization (please note that the Association never fundraises door to door);
  • submit false orders, false requests, spam or automated submissions, or attempt to defeat our anti-spam measures;
  • probe, scan or test the vulnerability of the Site, attempt to bypass our firewall or security measures, or attempt to gain unauthorized access to any account, server or database;
  • introduce viruses, malware or other harmful code, or interfere with the Site’s operation, including through denial-of-service attacks or excessive automated requests;
  • scrape, harvest or collect information about other users or our members, including email addresses;
  • use the Site to send unsolicited commercial messages; or
  • use the Site in any way that could damage the reputation of the Association or mislead the public about emergency services.

We may log and investigate suspected violations, block access, and report unlawful activity to law enforcement.

8. Online store terms

Our online shop offers items such as our 70th Anniversary Challenge Coin and donation items. These store terms apply to all orders.

8.1 Products and descriptions

We try to describe and photograph our items accurately. Because items such as challenge coins are made in batches, minor variations in color, finish or packaging may occur. Photos are for illustration.

8.2 Pricing

All prices are in U.S. dollars. The 70th Anniversary Challenge Coin is $20 each. Shipping within the United States is a flat $7 for up to two coins; please contact us at [email protected] for orders of three or more coins. Local pickup in DeBary is free. Prices, shipping charges and offerings may change at any time, but changes will not affect an order we have already accepted. If any tax applies to an order, it will be shown at checkout or before we accept your order.

8.3 Availability

Items are offered while supplies last. Challenge coins and other items may be produced in limited quantities. If an item you ordered becomes unavailable, we will let you know and offer a substitute (if one is available) or cancel that part of the order and refund any amount you have paid.

8.4 Orders and acceptance

Placing an order is an offer to buy. The automatic order confirmation email you receive does not mean we have accepted your order. We accept your order when we ship it or tell you it is ready for pickup. We may refuse or cancel any order, including for suspected fraud, errors in price or description, quantity limits, or if payment is not received. If we cancel an order after you have paid, we will refund what you paid.

8.5 Payment

Our checkout offers two payment methods:

  • Check by mail. Make your check payable to “The DeBary Volunteer Firemen’s Association, Inc.” and mail it to PO Box 530853, DeBary, FL 32753-0853, including your order number. We hold your order until your check is received. If we do not receive payment within 21 days of your order, we may cancel it. If a check is returned unpaid, we may cancel the order and may collect any service charge permitted by Florida law.
  • Pay at local pickup. Pay when you collect your order in DeBary, using a payment method we confirm with you when arranging pickup.

Some pages offer links to PayPal or Venmo. These are external services operated by those companies, and your use of them is governed by their terms and privacy policies. We do not collect or store card numbers on the Site.

8.6 Shipping

We ship by the U.S. Postal Service to addresses in the United States only. For international orders, please contact us first. Processing and delivery times are estimates, not guarantees, because our shop is run by volunteers. Details are in our Donation, Shipping & Refund Policy. You are responsible for giving us a complete and correct shipping address.

8.7 Local pickup

If you choose local pickup, we will contact you to arrange a time and place in DeBary. Please bring your order number. If an order is not picked up within 30 days after we tell you it is ready, and we cannot reach you after reasonable attempts, we may cancel the order and, if you paid in advance, refund your payment.

8.8 Title and risk of loss

For shipped orders, title and risk of loss pass to you when we deliver the package to the carrier. For pickup orders, they pass to you when the item is handed to you. Even so, if a shipment is lost or arrives damaged, please contact us. We will work with you as described in our Donation, Shipping & Refund Policy.

8.9 Returns and refunds

Returns, refunds, cancellations, and lost or damaged items are handled under our Donation, Shipping & Refund Policy.

8.10 Errors

We try to avoid errors, but the Site may occasionally contain mistakes in prices, descriptions or availability. We may correct errors at any time, including after an order is submitted, and may cancel an order affected by an error and refund any payment.

9. Donations

  • Voluntary gifts. Donations are voluntary gifts to support the Association’s mission. Unless an item’s description says otherwise, you do not receive goods or services in exchange for a donation.
  • Designated funds. When you give to a designated fund, such as the Firefighter Rehab Supplies Fund or the Fire Station 39 Equipment Fund, we will use your gift for that purpose. If a designated need has been fully met or becomes impractical to meet, we will use the gift for a closely related purpose consistent with our mission.
  • Not tax-deductible. Contributions or gifts to The DeBary Volunteer Firemen’s Association, Inc. are not deductible as charitable contributions for federal income tax purposes. The Association is a 501(c)(4) social welfare organization, not a 501(c)(3) charity. Please consult your own tax advisor about your situation.
  • Refunds. Donations are generally final. We will refund donations made in error as described in our Donation, Shipping & Refund Policy.
  • Recognition. We may thank donors publicly (for example, on Facebook) only with their permission. Tell us if you prefer to stay anonymous.

10. Events, presentations and hall use

10.1 Events

We hold events such as pancake breakfasts and community gatherings, listed on our Upcoming Events page. Dates, times, locations, menus and activities may change or be cancelled, including for weather, emergencies or volunteer availability. Tickets or donations for a cancelled event are handled under our Donation, Shipping & Refund Policy. Events may be photographed or recorded and images may be used on the Site or our social media. If you prefer not to be photographed, please tell a volunteer at the event, and contact us if you would like an image of you removed.

Attendees must follow volunteers’ instructions, posted rules and the rules of the host facility. We may refuse entry to or remove anyone who behaves unsafely or disruptively.

10.2 Fire-safety presentations

Our presentations share general, educational fire-safety information. They are not fire inspections, code consultations or professional assessments of any building, product or plan. Requesting a presentation does not guarantee that we can provide one; scheduling depends on volunteer availability.

10.3 Hall-use requests

The Association Hall at 10 Colomba Road, DeBary, the community’s original firehouse, may be available for community use by donation. See our Facility Usage page. The following terms apply:

  • Submitting a hall-use request does not reserve the hall. A reservation is confirmed only when the Association approves it in writing (email is fine).
  • Hall use is by donation. Any suggested donation, deposit, insurance or other requirement will be communicated before approval.
  • The person requesting hall use must be 18 or older, must be present for the entire event, and is responsible for the conduct of all guests, vendors and participants.
  • Users must follow all rules provided by the Association at the time of approval, including any limits on occupancy, hours, decorations, cooking, alcohol, smoking and parking, as well as all fire codes and laws. Exits, fire extinguishers and fire-safety equipment must never be blocked or tampered with.
  • Users must leave the hall clean and in the condition they found it, and are responsible for the cost of repairing any damage, loss or extra cleaning caused by their event.
  • The Association may cancel or change an approved reservation if the hall is needed for emergency support, becomes unavailable or unsafe, or if the user violates these Terms or hall rules. If we cancel for our own reasons, we will try to give as much notice as possible.
  • The Association may require a separate written hall-use agreement, release or proof of insurance. If there is a conflict, the separate agreement controls.

10.4 Assumption of risk, release and waiver

Participation in events and use of the Association Hall involve risks, including slips, trips and falls, burns, food allergies, weather conditions and other hazards. To the fullest extent permitted by Florida law, by attending an Association event or using the Association Hall, you (on behalf of yourself, your guests and, if applicable, your minor children) voluntarily assume these risks, and you release and agree not to sue The DeBary Volunteer Firemen’s Association, Inc., its officers, directors, members, volunteers and agents for any injury, illness, death, loss or damage arising from your participation or use, except to the extent caused by their gross negligence or intentional misconduct.

If you use the hall, you also agree to indemnify and hold harmless the Association and its officers, directors, members, volunteers and agents from claims made by your guests, vendors or participants, and from damage caused by your event, except to the extent caused by the Association’s gross negligence or intentional misconduct. Nothing in this section limits any rights that cannot be waived under applicable law.

11. Third-party links and services

The Site contains links to websites and services we do not control, such as Facebook, PayPal, Venmo, and government and safety organizations. We provide these links for convenience and information. We do not endorse and are not responsible for their content, products, services, availability or privacy practices. Your use of any third-party service is at your own risk and subject to its terms.

12. Disclaimers

The Site and its content are provided for general information. Fire-safety and preparedness information is educational and is not professional advice; always follow the instructions of emergency officials, manufacturers and qualified professionals. See our Disclaimer for more.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE, ITS CONTENT AND ALL ITEMS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure or error-free, that content is complete or current, or that the Site is free of viruses or other harmful components. Challenge coins are commemorative items and are not intended for any practical or safety use.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE ASSOCIATION AND ITS OFFICERS, DIRECTORS, MEMBERS, VOLUNTEERS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING OUT OF OR RELATED TO THE SITE, THESE TERMS, ANY ORDER OR DONATION, ANY EVENT OR ANY HALL USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE, AN ORDER OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE ORDER OR SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some laws do not allow certain limitations, so some of these limits may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, and nothing in these Terms waives any protection available to volunteers or nonprofit organizations under Florida or federal law, including the federal Volunteer Protection Act of 1997 and section 768.1355, Florida Statutes.

14. Indemnification

You agree to defend, indemnify and hold harmless the Association and its officers, directors, members, volunteers and agents from any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your Submissions, your violation of these Terms or the law, or your violation of anyone else’s rights. We may assume control of the defense of any matter subject to indemnification, and you agree to cooperate with us.

15. Governing law

These Terms and any dispute arising out of or related to them, the Site, an order, a donation, an event or hall use are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and by applicable federal law.

16. Dispute resolution and venue

  • Talk to us first. Most concerns can be resolved quickly and informally. Before filing any claim, you agree to contact us in writing at the address below, describe the problem and the resolution you want, and give us 30 days to try to resolve it.
  • Venue. If we cannot resolve the dispute informally, any lawsuit must be brought exclusively in the state courts located in Volusia County, Florida (the Seventh Judicial Circuit and the County Court for Volusia County), or, if federal jurisdiction exists, in the United States District Court for the Middle District of Florida, Orlando Division. You and the Association consent to the personal jurisdiction of those courts.
  • Small claims. Either party may bring an individual claim in small claims court in Volusia County if the claim qualifies.
  • Injunctive relief. Nothing in this section prevents either party from seeking emergency or injunctive relief to protect its intellectual property, security or safety.

17. Termination

We may suspend or end your access to the Site or our services at any time if you violate these Terms or if we must do so to protect the Site, the Association or others. Sections that by their nature should survive (including intellectual property, user submissions, store terms for completed orders, release and waiver, disclaimers, limitation of liability, indemnification, governing law and dispute resolution) will survive any termination.

18. General terms

  • Severability. If any provision of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Entire agreement. These Terms, together with the policies they reference and any separate written agreement (such as a hall-use agreement), are the entire agreement between you and the Association about their subject matter.
  • Assignment. You may not assign these Terms without our written consent. We may assign them to a successor organization.
  • Headings. Headings are for convenience only and do not affect interpretation.
  • Notices. We may give you notices by email to the address you provided or by posting on the Site. You may give us notices at the contact details below.

19. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page, and for significant changes we will provide a more prominent notice on the Site. Changes apply from the date they are posted and do not affect orders already accepted or disputes that arose before the change. Your continued use of the Site after changes take effect means you accept the updated Terms.
